Terms of service

1. Introduction

These terms of service (the "Terms") set out the conditions for using "Yorimichi Closet" (the "Service") provided by Hidamari Digital Works (the "Operator"). By using the Service you are deemed to have agreed to these Terms.

The Service is a fan-made service for searching and browsing outfits and accessories compatible with VRChat avatars, based on product information from Booth.pm ("BOOTH"). It is not an official BOOTH service.

2. Copyright and ownership of data

Copyright in the names, images and descriptions of items and avatars listed on the Service belongs to the respective rights holders (creators and shop owners). The Service provides information published on BOOTH by crawling it, and does not create original content.

Copyright in the parts specific to the Service, such as its logo, UI design and source code, belongs to the Operator.

3. Use and reproduction of content

Product information listed on the Service (images, descriptions and so on) is the copyrighted work of the respective rights holders. Please refrain from reproducing or redistributing information viewed through the Service without permission. Purchases and browsing should be done at each rights holder's BOOTH shop.

4. Takedown requests by rights holders

Rights holders (shop owners) of items and avatars listed on the Service may request removal or hiding of a listing on reasonable grounds.

• Requests are accepted through the "takedown request for rights holders" form.
• When making a request, you will be asked to complete a procedure confirming that you own the BOOTH shop (embedding a verification code).
• Requests where identity has been confirmed are handled promptly (normally within three business days).
• After confirmation the listing is hidden and excluded from the crawler.

5. User-posted content (timeline)

In the "Outfits" timeline feature, signed-in users can post outfit images.

• Copyright in posted images and text belongs to the poster.
• By posting, you are deemed to consent to the Operator using the content for the purpose of promoting and improving the Service.
• Posts that infringe others' copyright, portrait rights or privacy are prohibited.
• Inappropriate posts may be hidden by the Operator through the reporting feature.

6. Prohibited conduct

Users must not engage in the following conduct.

• Excessive automated access, scraping or DoS attacks against the Service
• Conduct that infringes others' copyright, reputation or privacy
• Posting compatibility reports containing false information
• Posting inappropriate or sensitive content
• Harassment of other users or creators
• Conduct that violates laws or public order and morals

7. Disclaimer

The Service does not guarantee the accuracy or timeliness of its data. BOOTH product information reflects the time of crawling, and prices, availability and avatar compatibility may differ from reality. Please confirm on each shop page and make the final purchase decision at your own responsibility.

Except in cases of the Operator's wilful misconduct or gross negligence, the Operator accepts no liability for damages arising from use of the Service (mistaken purchases, incompatibility with an avatar and so on).

Notwithstanding the preceding paragraph, where the user is a consumer under Japan's Consumer Contract Act and suffers damage due to the Operator's negligence (excluding gross negligence), the Operator's liability is limited to the total amount the user paid for paid services in the 12 months preceding the damage. The Operator accepts no liability for damages in respect of use within the free tier.

The Operator may suspend or terminate all or part of the Service without prior notice due to maintenance, faults, or the interruption of third-party services (BOOTH, payment processing, CDN and so on).

8. Account suspension

If a user violates these Terms or engages in inappropriate conduct, the Operator has the right to suspend the account or restrict features without prior notice.

9. Changes to these Terms

These Terms may be changed as needed. Significant changes will be announced within the Service. Continuing to use the Service after a change is deemed acceptance of the revised Terms.

10. About paid services

The Service offers paid options that unlock additional features specific to this service: the monthly "Premium" and "Creator Pro" plans, and one-off "promotion slots" (item boosts).

• What is sold is the right to use features and placements specific to this service, such as more closet slots, private closets, sale alerts, a longer analysis period and in-service promotion slots. It does not sell the products or data of third parties (BOOTH creators and so on); each item is purchased at the respective rights holder's BOOTH shop.
• Premium costs 500 yen per month (tax included) and Creator Pro costs 980 yen per month (tax included). Both are charged by credit card (payment processing: Stripe) and renew automatically every 30 days. Promotion slots are one-off purchases at a fixed price based on impressions (5,000 impressions for 1,500 yen / 15,000 impressions for 3,800 yen, tax included, 30-day placement).
• You can cancel a monthly plan at any time. After cancelling, future charges stop and the features remain available until the end of the period already paid for.
• Given the nature of the service, we do not, as a rule, provide pro-rata refunds for a period already paid for, nor refunds for a promotion slot whose placement has started. We handle cases such as serious faults on our side individually.
• After payment, the relevant features are normally enabled immediately (at the latest within 24 hours). Promotion slots go live after our review.
• Prices and what is offered may change. Changes are announced within the Service and, for monthly plans, apply from the next renewal. See the Notation based on the Act on Specified Commercial Transactions for details.

11. Use by minors

If you are a minor, please use the Service with the consent of a parent or other legal guardian. Consent of your legal guardian is required to subscribe to a paid service. By using the Service or subscribing to a paid service, you are deemed to have obtained that consent.

12. Governing law and jurisdiction

These Terms are governed by the laws of Japan. Any dispute between the Operator and a user regarding the Service or these Terms shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Operator's location as the court of first instance.
